Who needs a licence or certificate?

You must have a licence if you:

  • are a pawnbroker
  • are engaged for at least six days a year in buying, selling or exchanging secondhand items or scrap metal (other than for personal use, enjoyment or as a gift)
  • earn at least $2000 in a year from the sale of secondhand items or scrap metal (other than for personal use, enjoyment or as a gift).

If you are in a partnership - every partner must hold a licence.

Do you need a certificate?

You must hold a certificate if you buy, sell or exchange for a licensed secondhand dealer, or if you issue pledge tickets for a licensed pawnbroker.

What are secondhand items?

Schedule 1 of the Secondhand Dealers and Pawnbrokers Act 2004 list all of the items that are considered secondhand goods.  If the items you sell are not on this list then you do not need to hold a licence.
