How to respond to a claim
The Act states that respondents must file responses to the claim. A timetable for filing responses is usually set at the preliminary conference.
What must be included?
To prepare a formal response, respondents need to analyse the claim and accompanying documents (including the Assessor’s report) and state in writing:
- which matters in the claim are accepted or agreed
- which matters are disputed, with reasons why
- the matters for which responsibility/liability is accepted
- the matters for which responsibility/liability is denied.
