You, or the prosecutor, may be ordered (by the court) to pay a sum of money if you fail to follow procedure throughout the course of your criminal case. This is especially applicable in cases where the procedural failure is significant and there is no reasonable excuse for that failure.
A procedural failure is defined as a failure, or refusal, to comply with any procedure set out in the Criminal Procedure Act 2011 or the Criminal Disclosure Act 2008.
