Form 16
This is the second step for seeking funding through the Proceeds of Crime Fund. This template should only be completed by organisations/agencies who have been informed that their Initial Proposal was shortlisted by the Panel.
Form 35a Notice of Proceeding when summary judgment sought by plaintiff.
Form 1 Notice of Proceeding. This form notifies the defendant that a proceeding has been taken against them in a District Court. It also provides the defendant with information about the court process.
Form 5 Third Party Notice. Use this form if you are the defendant, and you wish to join a person to the proceedings who is not already a party.
Form 6 List of Documents Relied On. When filing a statement of claim, statement of defence, or other pleading, you need to file and serve on the other parties (at the same time as the pleading) a list of all the documents referred to in that pleading. Form 16 Affidavit of Service. This form is used to prove service of documents. It must be filed when a party is applying for judgment by default.
Form 17 Interlocutory Application on Notice. An interlocutory application is used to apply for court orders which are subsidiary to the main proceeding. Most interlocutory applications will have to be on notice (which means the other party/parties are given the opportunity to oppose the application). If you wish to rely on any evidence in support of your application, this must be in the form of an affidavit. This must be filed and served at the same time as the application.
Form 18 Interlocutory Application without Notice. An interlocutory application is used to apply for court orders which are subsidiary to the main proceeding. This template is for an interlocutory application without notice (which means the other party/parties are not given the opportunity to oppose the application). If necessary you may file an affidavit in support of your application. This must be filed and served at the same time as the application.
Form 19 Notice of Opposition. Use this template if you have been served with an interlocutory application, originating application, or application for summary judgment that you wish to oppose.
Form 20 Interlocutory Order. Use this form if you have obtained an interlocutory order and you want to, or are required to, have the order sealed.
Use this form if you have had a: trial and the judge has issued his or her decision formal proof hearing for a judgment by default on a unliquidated demand (please modify the form as required if using it for a judgment by default determined by a formal proof hearing)
Form 35 Certificate of Judgment Order - amended for District Court Act 2016. A certificate of judgment/order is either: Used for evidential purposes, usually for bankruptcy proceedings. Used for the purpose of removing a District Court judgment/order into the High Court.
Form 50 Affidavit in Support of Application for Charging Order. This affidavit must be filed when making an application for an interim/final charging order in form 49.
Form 51 Charging Order on Land. You will need to file draft copies of this order when making an application for a charging order on land (using form 49). Please file one copy for the court, one copy for yourself, and one copy for every party to be served.
Form 52 Interim Charging Order, District Court, Civil. You will need to file draft copies of this order when making an application for an interim charging order (using form 49). Please file one copy for the court, one copy for yourself, and one copy for every party to be served.
Form 53 Final Charging Order. You will need to file draft copies of this order if your application to make an interim charging order a final order (using form 55) is granted. Please file one copy for the court, one copy for yourself, and one copy for every party to be served.
Form 92 Application for Restraining Order. Use this form to apply for a Restraining Order if someone is harassing you.
Form 93 Application for Variation or Discharge of Restraining Order. Use this form if you want the court to make a Restraining Order last longer or you want to change or end a Restraining Order.
Form 95 Notice of Residential Address and Request for Confidentiality. Use this form if you want to keep your address private.
Form 96 Notice of Defence. Use this form if you’ve been served with an application for a Restraining Order or an application to vary or discharge a Restraining Order and you want to defend the application.
Form107 Summons for assaulting officer of court or rescuing goods. This editable form has been updated to reflect the new District Court Act 2016.
Form 111 Order for repayment of money extorted, or payment of money levied, and for damages, costs, and fine. This editable form has been updated to reflect the new District Court Act 2016.
